These Terms of Service ("Terms") govern your use of SpectroNova, the websites at spectronovasoft.com, the SpectroNova web, desktop and mobile applications, and related services (together, the "Service"), provided by GmTech Inc. ("GmTech", "we", "us"). By using the Service you agree to these Terms. If you use the Service on behalf of an organisation, you agree to them for that organisation.
1. The Service and your agreement with us
Your organisation's subscription to SpectroNova is governed by the agreement or order it signed with us. Where that agreement and these Terms differ, the agreement prevails.
2. Accounts
You are responsible for keeping your sign-in details confidential and for activity under your account. Tell us promptly at sales@spectronovasoft.com if you believe your account has been used without your permission.
3. Your data
Your organisation keeps all rights in the data and files it puts into SpectroNova ("Customer Data"). We use Customer Data only to provide, secure and support the Service, as described in our Privacy Statement .
4. Connected services
SpectroNova can connect to services you choose, such as Google Drive, Microsoft OneDrive and SharePoint. Your use of those services is subject to their own terms. We access them only with your permission, read-only, and only to provide the features you use, as described in our Privacy Statement. You can disconnect them at any time.
5. Acceptable use
You agree not to misuse the Service, including by: accessing data you are not authorised to access; attempting to break, probe or overload the Service; uploading malicious code; or using the Service to break the law or infringe others' rights.
6. Our intellectual property
The Service, including its software and design, belongs to GmTech and its licensors. Except for the right to use the Service under your organisation's agreement and these Terms, no rights are granted to you.
7. Availability and changes
We work to keep the Service available and secure, but it may occasionally be interrupted for maintenance or reasons outside our control. We may improve or change features over time.
8. Suspension and termination
We may suspend access that breaks these Terms or puts the Service or other users at risk. Your organisation may stop using the Service as set out in its agreement with us.
9. Disclaimers and liability
Except as stated in your organisation's agreement with us, the Service is provided "as is", and to the extent the law allows, GmTech is not liable for indirect or consequential losses arising from its use.
10. Changes to these Terms
We may update these Terms. We will post the new version here with its date, and for significant changes we will tell your organisation in advance.
